RE: The tariff classification of girls’ blouses and shorts sets from Indonesia

Dear Ms. Adams:

In your letter dated January 5, 2000 you requested a tariff classification ruling.

Three sets of samples were submitted under SKU# 5-419-0177, each set consisting of a girl’s blouse and shorts in matching woven fabric. Style #78915 is made of 65 percent polyester and 35 percent cotton printed twill fabric. The sleeveless blouse features a two-piece shirt collar, a patch pocket on the upper left side, and a full frontal opening secured with four-buttons and hemmed bottom ties. The matching pull-on shorts feature an elasticized waistband, two front pockets, and cuffed leg openings.

Style #78913 is made of 65 percent polyester and 35 percent cotton printed sheeting. The sleeveless blouse features a round neck, a full frontal opening with a four-button closure, an embroidered applique on the lower left front, and a bottom hem trimmed with rickrack. The pull-on shorts feature an elasticized waistband, an embroidered applique on the lower right leg, and bottom hemmed leg openings trimmed with rickrack.

Style #78911/12 is made of 65 percent polyester and 35 percent cotton printed twill fabric. The sleeveless blouse features a shirt collar, a full frontal opening with a four-button closure, two mock pockets with flaps and buttons sewn to the upper right and left sides on a front yoke, and a hemmed bottom. The shorts feature a waistband with two front belt loops, elasticized in back with three belt loops, a zip-fly with a button closure, two front pockets, and hemmed leg openings.

All of the styles will be imported in girls’ sizes 4 to 14.

The applicable subheading of the girl’s blouse in style #78915 is 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides track suits, ski-suits and swimwear; other garments, women’s or girls’: of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206. The rate of duty will be 16.4 percent ad valorem. The applicable subheading for the girls’ blouses in style #78913 and style #78911/12 will be 6206.40.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other…other: girls’: other. The rate of duty will be 27.6 percent ad valorem.

The applicable subheading for all of the girls’ shorts will be 6204.63.3540, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): trousers, bib and brace overalls, breeches and shorts: of synthetic fibers: other: other: other: other: other…shorts: girls: other. The rate of duty will be 29.3 percent ad valorem.

All of the samples will be returned to you as requested.

All of the blouses fall within textile category designation 641 and all of the shorts fall within textile category designation 648. Based upon international textile trade agreements products from Indonesia are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
